Shoulder pain pump class action litigation is now underway against the manufacturers of pain pumps, whose products have permanently damaged victim’s shoulders (or knees). These lawsuits also charge these manufacturers with failing to warn surgeons about the possible risks associated with the pumps, and bypassing FDA testing and approval.
Among the pain pump manufacturers named in the PAGCL lawsuits are:
- Styrker Corporation (Stryker pain pumps)
- I-Flow Corporation, a subsidiary of Kimberly-Clark (I-Flow pain pump, ON-Q Painbuster, Soaker Catheter, C-Bloc)
- DJO Inc. (DonJoy Pain Control Device, McKinley pain pumps)
- Sorensen (Sorensen pain pumps)
- DePuy, Inc.
- Smith & Nephew
- Breg Inc. (Breg pain pumps)
In 1998, one pain pump manufacturer, McKinley Medical (DJO Inc,), sought FDA permission to revise its labeling to indicate that the pumps could be inserted in joints. The FDA refused because it said no studies existed to prove it was safe.
Another major manufacturer, Stryker, has been accused of ignoring the FDA’s request for safety studies when Stryker applied for approval three times between 2000 and 2002 to use its Styker pain pump.
Current and future lawsuits will prove that manufacturers were late in warning surgeons about the risk of PAGCL with shoulder surgeries. For example, the manufacturer of the I-Flow pain pump posted a warning on its website to doctors only in 2007, several years after its introduction. Currently, I-Flow itself is defending against 191 PAGCL cases, involving 412 victims.
Pain pump litigation is continuing with individual lawsuits and possible pain pump class action lawsuits. A recent PAGCL lawsuit in Oregon awarded a PAGCL victim $4.5 million from I-Flow for damages associated with his shoulder injury.
